Terms of Agreement & Acceptance

Send My Stuff To Space Ltd will need the signed Terms & Conditions, along with a 100% payment cleared at least 21 days prior to the launch unless otherwise agreed. Once signed, this proposal becomes a binding agreement made between Send My Stuff To Space Ltd and the interested party.

Payment

Send My Stuff To Space Ltd requires a 100% deposit upon acceptance of the proposal due to the material and organisational costs associated with space flight. We require this deposit 21 days in advance of the launch due to local flight licensing & permissions taking up to 21 days to clear. This process can only be began upon full payment due to the costs involved.

Cancellation Policy

In the event that the client decides the launch needs to be cancelled, the below will apply.

  • Under most circumstances, Send My Stuff to Space Ltd are able to re-schedule your flight to a later date, however no refunds will be processed should a client cancel their launch, under any circumstance, due to the costs involved in space flight.

Unusable Footage

Should the flight suffer any form of technical failure that renders the footage unfit for use, Send My Stuff to Space Ltd will offer complimentary re-launches until the footage is of satisfactory standards.

Clients will be offered sign off on their product’s placement and camera angle up to a week before launch (‘camera preview’), once signed off no re-launches will be issued based on the product’s placement or camera angle, unless through technical failure (e.g rig movement during flight causes significant camera angle change from camera preview). Once signed off by the client, the product placement, camera angle and settings are set to the rig and cannot be changed before the launch.

If the Client fail to sign off on the camera preview within 48 hours, Send My Stuff To Space Ltd will act in the best interest of the client and sign off acceptable product placement and camera angle.

Likewise, product placement and camera angle that has been determined by Send My Stuff to Space Ltd due to client failing to sign off the preview within 48 hours will not qualify for complimentary re-launches unless due to technical failure.

The staff at Send My Stuff to Space Ltd will only send footage of the highest quality onto our clients, but in the rare event you would like to request a re-launch please email Harry Spring at Harry@sendmystufftospace.com.

Usage

All footage created by Send My Stuff To Space Ltd are property of the client and can be resold or reused without purchasing permission and copyrights from Send My Stuff To Space Ltd.

Send My Stuff To Space Ltd may use client’s footage as part of our marketing campaigns, however should the client not grant this permission to Send My Stuff To Space Ltd, the client should let Send My Stuff To Space Ltd know in writing at any time in advance or after the launch date.

Property

Send My Stuff To Space Ltd is not responsible for any damages to personal or corporate property, lost or damaged while engaging with Send My Stuff To Space Ltd , prior to, during or upon completion of the launch. Whilst we have industry leading recovery rates, Send My Stuff To Space Ltd encourages, due to the nature of space travel, clients to only send items to space that they are willing to lose.

We request our clients send up to three duplicates of their products in case re-launches are needed. Send My Stuff to Space Ltd can then re-launch immediately should we need to.

Send My Stuff to Space Ltd will return all recovered items to our clients within 14 business days.

Delivery Schedule

Send My Stuff To Space Ltd will inform the client in advance of signing this agreement an anticipated delivery date of the Client’s launch.

Send My Stuff To Space Ltd have an extended history of delivering over 99% of launches on time due to built in date buffers and advanced planning. Send My Stuff To Space Ltd will do everything within their power to ensure this delivery date is adhered to, but with the nature of Space Flight relying on a multitude of factors, (ground weather, CAA/FAA permissions, high-altitude jet-streams, landing location, theft/damage/malfunction etc.) clients should be made aware that no refunds or compensation will be given should this date not be met.

Send My Stuff To Space Ltd will communicate any anticipated delay in launch with clients immediately.

Clients purchasing additional video editing packages should expect additional video packages delivered within 5 working days of the launch date. Additional revisions will be delivered within 3 working days where reasonably possible.

Shipping

Client’s products should be received by Send My Stuff To Space Ltd 10 days prior to the launch date, unless otherwise agreed in writing with Send My Stuff To Space Ltd.

Should client’s products not be received within 10 days, Send My Stuff To Space Ltd reserves the right to push back the launch date, without compensation to the client.

Send My Stuff To Space Ltd recommend sending products via signed delivery services to ensure the safe delivery of products.

Send My Stuff To Space Ltd will confirm receipt of the client’s product no later than 24 hours after receiving the client’s product.

Send My Stuff To Space Ltd will endevour to return the client’s products within 14 days of product recovery after the launch.

Privacy Policy

Send My Stuff To Space Ltd respects the privacy rights of our online visitors and event participants and recognises the importance of protecting all information that you may choose to share with us.
Send My Stuff To Space Ltd is deeply committed to your right to privacy and takes your privacy seriously. We have very strict privacy policies and strive to keep your personal and financial information secure.

This Privacy Policy (‘Privacy Policy’) covers Send My Stuff To Space Ltd treatment of personally identifiable information that Send My Stuff To Space Ltd collects when you are on the Send My Stuff To Space Ltd website (the ‘Site’).

We will never sell or rent your name, email address or personal information to any third party except to fulfil your order, unless specifically authorised by you.

No Warranties

This service is provided “as is” without any representations or warranties, express or implied. Send My Stuff To Space Ltd makes no representations or warranties in relation to our services or the information and materials provided within these terms and conditions

Nothing in these terms and conditions constitutes, or is meant to constitute, advice of any kind. If you require advice in relation to any (legal, financial or medical) matter you should consult an appropriate professional.

Limitations of Liability

Send My Stuff To Space Ltd will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, our service:

  • for any indirect, special or consequential loss; or

  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Send My Stuff To Space Ltd has been expressly advised of the potential loss.

Exceptions

Nothing in this disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Send My Stuff To Space’s liability in respect of any:

  • death or personal injury caused by Send My Stuff To Space’s negligence;

  • fraud or fraudulent misrepresentation on the part of Send My Stuff To Space; or

  • matter which it would be illegal or unlawful for Send My Stuff To Space Ltd to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Reasonableness

By using this service, you agree that the exclusions and limitations of liability set out in this disclaimer are reasonable.

Other Parties

You accept that, as a limited liability entity, Send My Stuff To Space Ltd has an interest in limiting the personal liability of its officers and employees.  You agree that you will not bring any claim personally against Send My Stuff To Space officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Send My Stuff To Space officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Send My Stuff To Space.
